Current English Law Essay
In relation to involuntary manslaughter what criticisms can be made of the current law. At present in English legal system there are two homicide offences murder and manslaughter. For the most serious, murder proof of an intention to kill or cause serious harm is needed for a successful conviction. If a partial defence is used in circumstances, such as provocation or diminished responsibility, then the offence is one of voluntary manslaughter. However, if someone kills but did not intend to cause death or serious harm but there was a death then they are liable to be convicted of involuntary manslaughter. There are numerous criticisms attached to Involuntary manslaughter as it covers a wide range of behaviour which can cause death, although one of the most prosecuted common law offences it is not yet become subject to any statutory definition or change and is in need of reform. Although Involuntary manslaughter is split up into two offences Gross negligence manslaughter and constructive/unlawful manslaughter a general criticism of involuntary manslaughter is that there are two major problems with the wide range of conduct covered by the offence. The offences range from cases which just fall short of murder where the accused was aware there was a risk of death or serious harm but did not intend to cause either to the victim (R v Wacker), cases where the person is a experienced professional who makes a small but serious mistake resulting in death ( R v Adomako) and cases whereby a minor assault can end in death (R v Mitchell). This leads to problems in sentencing and labelling, including the fundamental problem that many cases currently amounting to unlawful act manslaughter involve only minor fault on the part of the defendant, and therefore should not be described as manslaughter at all. The law commission have also identified a problem specific to constructive manslaughter the stated it is wrong for a defendant to be liable for a death which he did not intend or foresee, and which would not even have been foreseeable by a reasonable person observing his conduct. It is a huge problem as it only requires a foreseeable risk of causing some harm not death a proposal for reform is that there should be the abolition of constructive manslaughter this would not allow defendants to escape liability as they would be liable for the newly proposed offence of Reckless Killing. They also identified problems specific to gross negligence manslaughter. Gross negligence manslaughter depends on the defendant owing a duty of care to the victim and the seriousness of the breach of that duty A person can be liable for omissions as well as acts. In the case of Adomako it mixes the civil concepts of ââ¬Å"negligenceâ⬠and ââ¬Å"duty of careâ⬠with that of criminal liability, creating uncertainty amongst cases as the gross negligence offence is based around a duty of care not civil matters. There are many inconstancies as The test in Adomako is circular the jury is to convict the defendant of a crime if they believe the conduct was ââ¬Ëcriminalââ¬â¢. This leaves a question of law to be decided by the jury who do not give reasons for their decisions or need to. The use of subjective recklessness manslaughter is also stated to be unneeded since Adomako.

When we speak of work-place bullying, we are actually referring to the verbal, physical, social or psychological assault that oneââ¬â¢s employer or manager, another individual or group of people carry out on a person. In other words it is the tendency of individuals to use increasingly aggressive attitude towards a co-worker or be very unreasonable towards him. This has become an increasingly important problem that Human resource department at most organisations have to counter.What makes workplace bullying far more difficult to counter than school-yard bullying is that it usually operates within the rules and regulations prescribed by the organisation and the society. Also, according to Ichniowski and Olson (2000), workplace bullies generally use words and actions to intimidate their victims, unlike playground bullies, who often resort to using their fists. Workplace bullying may involve verbal, non-verbal abuse tactics, humiliation, physical and psychological aggression.Workplac e bullying isnââ¬â¢t specific to a certain type of work-environment, as it can happen in any type of work condition, ranging from offices to workshops, from highly bureaucratic work environments, like the military, to highly casual ones. Workplace bullying may take different forms such as being rude or confrontational, damaging property that belongs to the organisation, social isolation, screaming and cursing others, physically assaulting them, etc.According to Ichniowski and Olson (2000), psychological and social bullying usually involves verbal abuse, aimed at making fun of oneââ¬â¢s work or the individual himself. This may include making fun of oneââ¬â¢s ethnicity, family, sexuality, race, education, etc. Isolation is another means of inflicting psychological aggression upon an individual. Workplace bullies will also try various methods of harassment and intimidation to upset your mind and make sure you arenââ¬â¢t able to focus on what you are supposed to, i. e. work. According to Lewis (2003), incase the bully is your boss or employer or supervisor, he or she might try to assign you pointless tasks that have nothing to do with your area of speciality or your job description. The other extreme end would be assigning you jobs that may be extremely boring, difficult or impossible to perform due to lack of time, or deliberately holding back information you need for getting your work done properly. Similarly, one might be a victim of physical bullying, where one may be attacked or threatened.According to Thomas (2005), acts of physical bullying include spitting, pushing, punching, shoving, kicking, tripping, scratching, grabbing, biting, attacking or threatening with equipment such as knives, club, gun, etc or any other type of direct physical contact. Physical bullying also includes sexual harassment, such as flashing or touching, or when you are made to do humiliating things in order to be accepted as part of a team, as stated byIchniowski and Olso n (2000).Incase of physical bullying, especially, one should immediately report the matter to the police and the employer or someone in the human resource department. One can also revert to the following steps in order to deal with a workplace bully, as explained by Ichniowski and Olson (2000): â⬠¢ Seek advice from a trusted individual or may be a mentor, who might be available in the same organisation or even outside, who may have been through a similar situation â⬠¢ One can also try to confront the bully in a professional manner, but keeping in mind oneââ¬â¢s own safety and giving it top priority.One should stay as calm as possible, and no sink to his or her level, and yell or threaten, as more often than not this is what bullies are looking for in the first place. And neither should one show weakness and cry, cause that might again motivate the bully to come back for more â⬠¢ One shouldnââ¬â¢t allow the bully to make one feel low self-esteemed, because only the individual would know his or her true worth or capacity â⬠¢ One should focus on the task in hand and try to do it well, because the bullyââ¬â¢s goal is most often to try and fail you in your job â⬠¢ One shouldn't let the bully isolate oneself from friends and colleaguesTo date, the phenomenon of workplace bullying is always associated with managers or colleagues who are the perpetrators, but that may not always be the case. There is something known as ââ¬Ëupward bullyingââ¬â¢ which may exist in organisations. In this case managers are actually the target. But since it is very rare, not much research or attention has been given to it. A recent research conducted on upward bullying by students of Griffith University, shows that work environment, change within organizations and power issues are the major contributing factors to upward bullying.According to Kelly (2000), organisations usually do not take workplace bullying by the neck, their policies are usually flawed which enables bullies to take advantage. In most cases the Human Resource Department is aware of who the aggressor is, but they usually wait for something illegal to happen, i. e. if its not illegal harassment there is no effort made to eradicate it. According to Kelly (2000), a research conducted by the University of Illinois indicates that workplace bullying occurs 4 times as frequently as compared to illegal forms of harassment or discrimination.WORKPLACE BULLYING AND THE HUMAN RESOURCE DEPARTMENT However, ideally speaking, an organisation would be better off taking strict action and notice against workplace bullies themselves rather than allowing individuals to do so. The first and foremost step for them would be to come up with an anti-harassment policy, or try to expand an existing anti-harassment policy if it hasnââ¬â¢t proven to be effective enough. Such a policy would also encourage witnesses to come forward and either second the targetââ¬â¢s claim or dismiss them.Als o, the human resource department should try to structure a dispute resolution process. This would encourage the targets to step forward sooner. According to Zapf and Einarsen (2001), the human resource department should also monitor the turnover rates and stress-related compensation claims taken by the workers within every department and every manager, so that even if a manager who is guilty of workplace bullying goes unreported, such an analysis ca bring him into the limelight.Another approach to tackling workplace bullying would be to offer courses and training to the supervisors and teach them to criticise employees without offending them. Also, in the present scenario, where, companies, especially the bigger ones have a well-diversified work force, the Human Resource should take claims of workplace bullying very seriously, because if they fail to treat such claims seriously, it would result in further isolation and mistrust on part of the employee.The leadership along with the H uman resource Department should realise the grave consequences workplace bullying may have on the overall efficiency and effectiveness of the organisation. According to Kelly (2000), in approximately 80% of the cases, the employees productivity is adversely affected. This unreasonable behaviour also affects the mental and physical health of the employees, resulting in a decrease in the job satisfaction and job involvement. According to Vartia (1996), it causes a decrease in the employeesââ¬â¢ morale, resulting in higher turnover rates.This also causes long term loses to the organisation as they employees that are bullied may sooner or later quit their jobs, this increases the companyââ¬â¢s overall advertising expenditure, as they have to advertise frequent job vacancies, and also train the new employee and explain him the job description and the kind of work he would have to perform. Now, the human resource department may respond to issues related to workplace bullying in 5 di fferent ways. The first one is called the Mafioso, which is perhaps the worst stance HR can take with regards to such a situation.In this case even though the HR is aware of the problem and the aggressors, they are not inclined to take any action. In other words they actively participate in bullying employees and support such activities from every possible angle. The second approach is called the Ostrich, where the HR department come up with muffled and sandy responses to reports of workplace bullying, such as saying that, we do not have such problem at the workplace nor are we gong to have one, etc. The third stance is termed as fire-fighter, where the Human Resource Department is overloaded with work, and they do not have time to focus or concentrate on such matters.WORKPLACE BULLYING AND THE LEADERSHIP Apart from the Human resource department itself, leadership of that particular organisation has a very important role to play in managing and curtailing employee behaviour and prev enting workplace bullying. If the leader can take a stand against any such activity, the chances of occurrence may drastically drop automatically. Leaders need to see all employees equally and avoid any biases when treating employees, as stated by Rayner and Cooper (2003). They should prohibit from doing acts that portray favourism towards a particular employee or a group of employees.EMOTIONAL INTELLIGENCE AMONGST INDIVIDUALS Also what might be of significant help when managing workplace bullying in organisations is if the individual has a higher degree of emotional intelligence. It helps employees manage their own mood along with the mood of the organization. It instils in them a greater degree of self-awareness and empathy allowing them to read and regulate their emotions while being able to intuitively grasp how others feel and gauge the emotional state of the organisation. According to Goleman (2000), there are five components to emotional intelligence.Self-awareness is the tra it where emotional intelligence actually begins, such individuals are never hesitant to talk about and discuss their weaknesses and it is this attitude that later brings upon a positive change in them as they are able to improve upon their weaknesses with the passage of time. According to Sheehan (1999), this helps them bring about a positive change as one becomes aware of his or her limitations and one knows when and where he or she can actually stand-up and deliver regardless of the obstacles that may come his way.The second trait is self-regulation, and individuals with this trait can control their emotions and impulses better and channel them for good purposes. This brings about an openness to criticism in their attitude and behaviour, and increases their trustworthiness and integrity, and also helps them remain comfortable in ambiguous and unreasonable situations and scenario, as discussed by Sheehan (1999). So, an individual with higher degree of self-regulation is never intim idated or threatened from workplace bullies, and he never reacts to any of their actions, which is what the bullies ideally want.Motivation is perhaps the most important trait and the most obvious one that an individual is judged upon in an environment where workplace bullying is rampant. The individual needs to self-motivate himself to performing his job and the tasks assigned to him without thinking too much about what activities or attitude other employee or employees have towards him. It portrays the optimism of the individual, and his dedication to the organisation, such that he is able to find positives from every negative thing that happens in his life, so it has to do more with the mind than anything else.Understanding the emotional makeup of others is referred to as empathy. In order to tackle workplace bullying, it is important for the individual to understand why the aggressor is trying to bully him, and what is he trying to achieve from such an act. This can greatly help individual in managing himself and his emotions and react the right way and not lose focus, as explained by Sheehan (1999). The last trait that comes under emotional intelligence is the social skills of the individual.It is the proficiency in managing relationships and building networks that can greatly help an individual to overcome the effects of workplace bullying. It is always a good feeling to have some support on your own side. This may also help in finding common grounds between individuals who are aggrieved and the bullies and it also enables one to build rapport. It also improves his persuasiveness and the ability to build and lead teams. THE CHALLENGE OF CULTURAL CHANGES As described earlier, workplace bullying is a problem that is more common than what people anticipate or realise.It not only impacts the individual himself, but also the organisation and the society itself is affected. And apart from resulting in lost productivity, there are other risks that it bring alon g for the organisation, which include legal expenses and settlement payouts. Many believe that changing the organisationââ¬â¢s culture is the way forward. The challenge for the Human resource department is to picture the prevailing problem of workplace bullying. They also need to identify how much of it is contributed due to the loop holes in the office rules, which describe an employeesââ¬â¢ conduct when at work.They also need to identify how much of an impact has training had in shaping their attitude and behaviour. Then comes the most important step, whereby, the human resource department needs to identify practical approaches to nurturing a culture that reduces bullying. Last but not the least, the Human Resource Department needs to identify a long-term approach to tackling such issues, i. e. they need to formulate a long-term strategy to eradicate workplace bullying. Education can be seen as the process which is transmits its knowledge, values and skills from one generation to the next generation. In this education is not used only to instill the values and norms of a given society. Different forms of education have different stucture of learning that define the learning process. Education is as a tool to reduce poverty, restructure the economy and to raise the standard of living for the people in this country. The government must take a serious stand of the on the development of higher and smooth education to work transition. Education is one of the most important investment that country can make it to reducing poverty and inequality. With education, it give a people critical skills and tools to help them better to provide for themselves and their children. Besides, it can helps people to work better and create opportunities for sustainable economic growth now and into the future. Girls and boys who learn to read, write and count will provide a better future for families and country. In short, education has the power that can make the world a better place. In this article, one of the ways of overcoming such problems is to encourage more (graduates) to be more entrepreneurial and to do that, must ensure they have more experience that will enable them to be more sustainable. Among the reason side for the unemployment was the lack of language proficiency particularly in English as well as not having sufficient knowledge and competency in the jobs that they applied for. The skills mismatches between employers and worker is one is one of many reasons leading to high graduate unemployment. Malaysia has produced many skilled workers in IT, science, and professional graduates that were aim to increase RD and raise productivity in our key leading sectors. The absence of quality leading institutions to absorb the lead such initiatives has resulted in high unemployment. Gender Imbalance In Education Gender inequality in education and employment poses a major challenge to development. The female advantage in terms of tertiary enrolment does not necessary directly into advantageous participation in the labour market. Although women are likely more than man to have a university education, female graduate are more likely than male graduates to be lower paying jobs or to be unemployed. Female enrolment has outnumber of males and this phenomenon has been attributed to the new gender gap. Closing the gender gap education has now become a development priority. This identified that education is the primary vehicle for woman that not only to build basic capabilities but also to play a meaningful role in bring equitable social and economic development. The government regards education is an important tool to empower the women of Malaysia and constantly strengthened its education system in addition to providing more educational opportunities for woman. Now, in our system woman in Malaysia are attending universities and are enrolled in various courses such as arts and humanities, science and technology as well as vocational and technical field. Males need to perform well at the school level in order to compete for places in university. Fewer high paying jobs would be available to men leading to changes in future workforce composition. Table 8.3 below in 2013 show the percentage and ratio of students at public higher education institutes by gender. Percentage of female students is the higher which is 61.02% than the male students which is 38.98%. This data showed the imbalances of gender between female and male students. This is because female students more to hardworking and to study in the higher instituition than male students. Lack of Science and Technical Graduates Malaysia is going to the rapid shift of production based economy to knowledge-based economy, so companies are progressively needed more of science and technical graduates. On the other hands, new graduates who are not meeting needs of industry due to the lack of crucial skills and innovations. So, it will be difficult when many companies are not willing to invest time and money to train new graduates due to budget and time constraints because companies have to conduct training workshops and courses which can be typically take up to two years. Some employers poor in English command of the English language among fresh graduates. In general, local graduates are highly qualified but not proficient in English language. Lack of skills issue Soft skills are nontechnical skills such as communication, management and leadership which are required to successful practice. This is because majority of students are not confident with their soft. Soft skills are very important in securing a job in the job market. They are unable to communicate effectively because they lack confident and have a poor command in English language. In addition, local companies are demanding English proficiency too (The Star, 10 April 2011). Even local company, they are looking for graduates who are creative, inventive and bold to success in the market job. It had stated that most employees require workers to possess qualities such as good attitude, strong work ethics, and the ability to communicate well, a willingness to learn and to contribute new ideas. It has been acknowledge by the general consensus of Malaysian employers that Malaysian graduates lack the soft skills although are well trained in their areas of specialization (Nurita, Shaharudin, Ainon, 2004). Soft skills is the most important skill, this is because they have to communicate clearly and persuasively during the job interviews. Malaysian education system focus to exam oriented. So, for those who complete their studies have a lack of these skill is common everywhere. Here, new graduate are a little more aware about it now and there has been a slight improvement but the challenge are the same. There is a fear of failure or being put in the spotlight. The Ministry of Higher Education (MOHE) has identified seven soft skills that should be possessed by all graduates as indicated in the Module for the Development of Soft Skills for Higher Learning Institution Malaysia, 2006 which include the skills for tertiary institutions need to inculcate among the local graduates: critical thinking and problem solving skills, communication skills, lifelong learning and information literacy, team working skills, professional ethics and morality, entrepreneurship skills and leadership skills. Soft skills are identified as generic skills and require training in contrast to hard skills which are associated with procedures or tasks that are observable, quantity and measurable. In facing the challenge of the job market, soft skills are required by university graduates. So, learning in tertiary classroom has moved away from teacher-centered to student-centered learning. Thus, it can be a necessary for those are searching a job nowadays especially for new graduates. Our system is through exam oriented, so many of the student are lack in their soft skills. In other to work transition is the supply of work to new fresh graduates are little bit. Many of company now need a graduates who have a soft skills that will be an innovative persons. So, our Malaysian education system must improve their system which is exam oriented. Another academic in a private institution of higher learning commented on lack of leadership in his institution. Poor leadership and lack of commitment and motivation from top management is one of the main reasons which creates a barrier to the growth and effectiveness of many private institutions and management school. A number of institutions employ retired academicians to occupy prime and decision-making positions and many of these retired academics lack vision, motivation and commitment with no interest in promoting the institutions and management education. Quality Issue Companies overwhelmingly agree that the content and quality of local university education do not adequately prepare students for the workforce while a weak basic education is also to be blame for producing graduates with adequate soft skills. The Malaysia education system must to differentiate between the various type of unemployment graduates, the reason why they are unable to find a work, and the interventions that must be taken to help them find employment. One possible explanation for the relatively high rate of graduate unemployment could be employers unwillingness to offer the level of compensation needed to meet the expectations of recent graduates and attract the required talent. So, Malaysia need to address the mismatch in skill formation and build a functioning feedback mechanism between educational institutions and the industry. A university of Malaya seven year longitudinal study of the school work transition (Nagaraj et al., 2009: 219) found that university graduates to have low regard for creativity and for risk taking. This bring us that fresh graduates increasingly view of the ability to think critically and creatively, and work independently. But graduates from Malaysian Universities seem to be lacking in these areas. In addition, government should look at improving incentives and recruitment for them for promoting professional development and career management (text book) Through the analysis of the current performance of national education based on the blueprint, government public examination lack of the ability to assess and reflect objectively the academic proficiency of students. This according to not only did our students performed poorly in higher level thinking, they also had difficulties with basic knowledge. This shows it is a very serious problem in managing the transition of our students. Besides, the public perception of the quality of education from industry perspective is based on the graph below. Industry perspective is refer to employers opinions about university graduates and these can be into five weaknesses listed as follows (Jobstreet survey, 2011): (1) unrealistic salary demands, (2) bad character, attitude and personality, (3) poor command of English language, (4) lack of good communication skills, (5) too choosy about the job. Thus, issues are faced by Malaysias education system are students problem to more to their attitude. The problems not only in the students knowledge and learning skills but also in their ways to interacting with people and handle their personal matters. Conclusion As the conclusion, Malaysian education system must have an incentive to managing work transition for those who complete their studies as they enter the world of work because many of fresh graduates had been seen was unemployment phenomenon. We notice there is over-emphasis on the number of students enrolment. This has reflected that our education is pay more attention to quantity instead of quality. The issues such as the problem of job mismatches, gender imbalance in education, lack of science and technical graduates, lack of skills issue, quality issue can be a problem for education system in managing for those who complete their studies as they enter the world of work. This bring us that fresh graduates increasingly view of the ability to think critically and creatively, and work independently. Then, issues are faced by Malaysias education system are students problem to more to their attitude. The problems not only in the students knowledge and learning skills but also in their ways to interacting with people and handle their personal matters. Increasing Airline Security Essay -- Papers
Increasing Airline Security Over the past five months, airline and airport security has been in the news almost daily. The events on and since September 11 have completely changed the viewpoints of many Americans, as well as the world, concerning airline security. Between the 18 suicide hijackers to Richard ââ¬Å"the shoe bomberâ⬠Reid and the many other terrorists that lurk in the world, flying is definitely not as safe as it once was. I strongly believe that security in airports should be much more strict than it is now, even if it infringes on the peopleââ¬â¢s right to privacy. The last part of that statement is the point of clash for many people because they strongly believe in privacy rights. Before I get to why there should be stricter airport security, I will define a few the main terms in this debate. First of all, stricter security calls for a more systematic, more careful searching of passengers, bags and airplanes for contraband items, like guns, knifes, explosives and anything that could be used as a weapon. I will go into more detail later about different practices to give airports stricter security. Another crucial part of this debate that perplexes many people is the phrase, ââ¬Å"right to privacy.â⬠Rights to privacy can be defined as the right to be left alone without unwarranted intrusion by the government, the media or other institutions or individuals. Article IV of the Bill of Rights states that ââ¬Å"the right of people to be secure in their persons, houses, papers and effects, against unreasonable searches and seizures, shall not be violated â⬠¦Ã¢â¬ Airline security has always been a very important issue, but the significance has multiplied exponentially since the September 11th terrorist attacks. On that horrific day, ... ...ace for those airports that do not follow the correct procedure. Depending on the size of the airport, fines should be high enough to make a difference to the owners. For example, an airport in New York City should have a very hefty fine of at least $25,000 per infraction. Smaller airports cannot afford such amounts, so the fines should be tailored to their income. The funding for these new procedures and equipment has been allowed for in the Presidentââ¬â¢s new budget for the fiscal year. Also, raising ticket prices only a few dollars each would help fund the new equipment. The fines from faulty airports could go into a fund to help pay for more equipment. Ultimately, I believe that these stricter changes would not only prevent events like those on September 11, but also they would deter would-be terrorists from even trying to breech the security at airports.

Tom escapes into his world of poetry writing and movies. Jim also reverts to his past and remembers the days when he was a hero. Even when it appears that Laura is finally overcoming her shyness and hypersensitivity with Jim, she instantly reverts back to playing the Victrola once he tells her he's engaged. She is unable to cope with the truth so she goes back to her fantasy world of records and glass figurines. Laura can only live a brief moment in the real. Amanda is obsessed with her past as she constantly reminds Tom and Laura of that 'one Sunday afternoon in Blue Mountain' when she received seventeen gentlemen callers (Williams 32). The reader cannot even be sure that this actually happened. However, it is clear that despite its possible falsity, Amanda has come to believe it. She refuses to acknowledge that her daughter is crippled and refers to her handicap as 'a little defect - hardly noticeable' (Williams 45). Only for brief moments does she ever admit that her daughter is 'crippled' and then she resorts back to denial. She doesn't perceive anything realistically. She believes that this gentleman caller, Jim, is going to be the man to rescue Laura and she hasn't even met him yet. She tells Laura when Laura is nervous about the gentleman caller, 'You couldn't be satisfied with just sitting home', whe... ...he major characters in this play are so warped and their lives so distorted and perverted by fantasies that each is left with only broken fragments of what might have been' (Davis 205). Mona Hatoum :: Artist Mona Hatoum Essays
Mona Hatoum Most art scholars and critics examine the work of Mona Hatoum in relation to her ethnic and geopolitically charged background. In her own writings and interviews, however, Hatoum cautions against this "journalistic" approach. For her, the most important element of her art is its relationship to the body. When Hatoum immigrated from the Middle East to England, she immediately felt a sense of displacement when she perceived a mind/body disjunct that contradicted her own cultural experience: â⬠¦it became immediately apparent to me that people were quite divorced from their bodies and very caught up in their heads, like disembodied intellectuals. So I was always very insistent on the physical in my work (Hatoum/Brett, 59). We relate to the world through our senses. You first experience an artwork physicallyâ⬠¦Meanings, connotations and associations come after the initial physical imagination, intellect, psyche are fired off by what you've seen (Hatoum/Archer, 8). I weigh this statement against theory by performance scholar Nelly Richard: The body is the physical agent of the structures of everyday experience. It is the transmitter of cultural messagesâ⬠¦a repository of memories, an actor in the theatre of power, a tissue of affects and feelings. Because the body is at the boundary between biology and societyâ⬠¦in terms of power, biography and history, it is the site 'par excellence' for transgressing the constraints of meaning (Richard, 208). Focusing on four works by Hatoum, I take a position that respects the artist's own intent and uses the body as a starting point for analyzing her work. However, I argue that it is necessary to consider her background in relation to the content of her art; it is because of her background as an exile from political violence that so much of Hatoum's work evokes a sense of danger by eliciting a visceral response from the viewer. I also argue that Hatoum's work insists that the viewer recognizes a second body, the implicit body of the oppressed. That insistence comes primarily from two elements of her background: her direct experience of living in the shadow of oppression, and her experience with feminist groups as an art student in London. Thus, in Hatoum's work, two bodies-the body of the viewer and an implicit body--engage in a dialectic. Necessarily then, I offer a brief glimpse into the background of Mona Hatoum. She is a Palestinian whose parents were exiled to Lebanon before she was born.

One-Sided Relationship Essay
In school there is always one kid that a person will hang out with, although that person does not want to be seen with him. They will only associate with that one person when they have no one else to hang out with or when they need something from them. It is evident through the novel The Kite Runner by Khaled Hosseini, that in a one-sided relationship there is always one person in a friendship who will unconditionally love the other person and one who will be willing to take advantage of the other. In the novel, Hassan will always do anything for Amir because he is a loyal and true friend. On the other hand, Amir only hangs out with Hassan when no one else wants to play with him. Amir does not notice how unfair his relationship with his best friend is until he brutally watches Hassan get raped in the alley by Assef. Through the actions of Hassan and Amir, it is evident that a one-sided relationship will not work out because there will always be jealousy, lies, and shame to deal with. Evidently, Amir and Hassanââ¬â¢s friendship is unhealthy because Amir is afraid to consider Hassan a true friend. He is afraid to consider Hassan a true friend because he feels shame in being the only Pashtun child playing with a Hazara boy because Hazaras are of a lower class. Amir is struck by the words Assef says to him, ââ¬Å"How can you talk to him, play with him, let him touch you? How can you call him your friend? If idiots like you and your father didnââ¬â¢t take these people in, weââ¬â¢d be rid of them by nowâ⬠(Hosseini 41). It is at this point that Amir truly considers his relationship with Hassan. He wonders why he only plays with Hassan when no one else is around and why when other kids come over they never include Hassan in any games. This is the point where their relationship begins to struggle because Amir cannot distinguish if Hassan is a friend or a servant to him. Additionally, Amir tests Hassanââ¬â¢s loyalty to prove that he is a true friend to h im. One of the ways in which he tests his loyalty is by asking, ââ¬Å"Would you eat dirt if I told you to?â⬠(54). Out of shame, Amir asks Hassan this question because he wants to see if he would be willing to do anything for him. Amir constantlyà looks to test his loyalty with questions like this one because Amir wants Hassan to say no in order to make himself feel better. He feels that if Hassan will not do one thing he asks, then it will make his doubts about his relationship feel better and not as one-sided. It is utterly clear that the boysââ¬â¢ relationship is unhealthy because Amir is always trying to test Hassanââ¬â¢s loyalty because he has developed too much shame in the way he treats Hassan to consider him a true friend. Furthermore, the relationship between Hassan and Amir is unhealthy because Amir has too much jealousy built up. Amir is jealous of Hassan because he has the attributes and talents that he wishes he had instead of his own. Amir is jealous of Hassan because he heard Baba exclaim, ââ¬Å"I see how they push Amir around, take his toys from him, give him a shove here, a whack there. And, you know, he never fights back. Neverâ⬠(22). Amir was offended when he heard his own father say this because at this moment he knew his father wished he was like Hassan. He learned that his father wished he was more athletic and did not read books all the time. Learning of this made him very jealous of Hassan because he had all of these features and was considered golden in the eyes of Baba. Additionally, Amir resents Hassan because he has always received attention from Baba and was treated like his favorite son. Amir is jealous of Hassan because he got a very thoughtful and loving birthday present: a doctor to fix his hairline lip. Amir does not understand why his father gave such a huge gift to Hassan because he had never received such a loving gift. Amir acknowledges the fact the he normally only receives a toy or little object from Baba and cannot comprehend the fact that his father put so much effort into Hassanââ¬â¢s gift. This makes Amir very jealous of Hassan because he yet again stole the attention from Baba. Overall the relationship of Amir and Hassan is very detrimental because Amir resents Hassan for having many of the things that he wishes he could obtain. Amir wishes he were more athletic and strong so that he could be the golden child in Babaââ¬â¢s eyes. Finally, the one-sided relationship comes to an end due to the fact that it cannot survive when too much hatred and lies have built up. One of the main reasons the relationship between Hassan and Amir failed was the fact thatà Amir enabled Hassan to get raped. Before being raped by Assef, Assef blurted, ââ¬Å"Youââ¬â¢re nothing more but an ugly pet. Something he can play with when he is bored, something he can kick around when he is angry. Donââ¬â¢t ever fool yourself and think youââ¬â¢re something moreâ⬠(72). After the rape, these words that were said stuck to both Hassan and to Amir who stood by aimlessly watching him get raped. Both boys knew that if it was the other way around, Hassan would have jumped in and tried to prevent the rape from happening. However, in reality, Amir was the reason their relationship came to an end because he simply just did not have love for Hassan the same way he was loved back. Moreover their relationship could no longer work after t he rape because Amir could not stand to look at Hassanââ¬â¢s face everyday and tell lies about what had happened that day in the alley. Amir tried to deal with this trouble by trying to get Baba to kick Hassan and his father out of his house. For example, Amir stuck his watch and birthday money under Hassanââ¬â¢s mattress so that Baba would get furious and kick them out of his house. However, Amirââ¬â¢s plans always backfired on him, which resulted in him having to live with more lies building up. Their relationship came crashing down hard after the rape because Hassan woke up from his little fantasy and learned how good of a friend Amir was to him. He came to realize that he would always love Amir, and in return it would take years before Amir would love him the way that he did. Overall the relationship of Amir and Hassan came to an end because Hassanââ¬â¢s eyes were opened and they could no longer live with such huge lies in their lives. Due to the fact that there will always be lies, shame, and jealousy to deal with in a relationship, it is obvious that a one-sided relationship will never work out for the best. The relationship of Amir and Hassan never worked out well because Amir was afraid to consider Hassan a true friend. He was only the person who was there for him when he needed it the most and no one else was there to play with. Also the relationship never worked out because Amir built up too much jealousy towards Hassan. Amir could not stand the fact that Hassan was the golden boy in his fatherââ¬â¢s eyes. He always wanted to be that boy, and came to realize he would never be because Hassan was perfect from his fatherââ¬â¢s point of view. Ultimately, their relationship came to an end because Amir let Hassan get raped, while he watched it allà happen and took no actions to prevent it. This led to too many lies and too big of a burden for Amir to live with. This caused him to build up hatred, which even tually made Hassan and his father leave his house. Clearly, the relationship could not work out because Amir could not love Hassan for who he was. People need to take this example of Amir and Hassan and apply it to their own lives. They need to realize that they cannot and should not take advantage of a friend or a person because it will result in a failed relationship and hatred will most likely arrive. Thus people need to be more considerate and caring to the people they live and socialize with in their daily lives.

Australia the Movie: Synopsis, History and Comparisons
In Australia, an aboriginal medicine man/witch doctor, King George was teaching a young aborigine named Nullah how to do various tasks in the Outback. When all of the sudden a group white men shoot King George with an arrow. Then, Nullah rides home on his horse to his home in Faraway Downs. He hears people coming and is scared that someone will take him away from his family, so he goes into hiding. However, the voices he hears and people he sees are Drover and Sarah. The property of Faraway Downs is Sarahââ¬â¢s and her husbandââ¬â¢s. When Sarah goes into her property she finds that her husband has been killed and he is lying dead across a table. Because of this Sarah decides she wants to sell her property to the Carney Empire. However, if Faraway Downs is sold, the company will have a monopoly over the cattle business. Sarah soon finds out from Nullah that Carney is stealing her cattle and driving them across the river. Soon after she hears the news she fires Fletcher (the current driver for her cattle) and hires Drover to drive in their 1,500 cattle. They need 7 people in all to successfully drive them all in so, Sarah, Nullah, his mother and grandmother, and an aborigine named Magarri offer their help. They could still use one more person but no others are willing or capable. Then one morning the police appear at the house and are looking for Nullah and his mother who are hidden in the water tower. Sadly, his mother drowns in the tower because the tank filled up when one of the men used the faucet to cool down. Now Nullah is motherless so Sarah decides to give it a shot and raise him herself. She does not do a wonderful job of this because she does not have any children of her own. Fletcher creates a stampede by lighting the brush on fire and has the cows heading towards a cliff. Some fall off the cliff but many cows were saved because Nullah resorted to song and magic to stop the cattle. Fletcher is attempting to hurt their cattle and destroy their plans on saving Faraway Downs by killing cattle, burning items and poisoning waterholes. At a ball Carney attempts to convince Sarah to sell Faraway Downs to him. However, she refuses and tells him that it is no longer for sale. A few days later Fletcher pushes Carney into water where an alligator attacked and killed him. Also, Nullah goes missing. But Drover believes he is safe and protected by King George. Unfortunately they are not safe and are caught by the police where Nullah is sent to the mission and King George is put in jail. There is a treat of war in the city of Darwin so the town is being evacuated. Sarah searches for Nullah and can hear his singing but cannot find him. He is being sent to another island to work on a mission. While Sarah is working at an Army radio headquarters Japanese planes bomb the headquarters and the building catches on fire. Also, the jail is hit and King George escapes. Drover thinks Sarah has died and rescues Nullah and the other children from the explosion on the island. Sarah survives the explosion and is reunited with her love, Drover and Nullah. Afterwards, they return safely to their farm and all survive the explosions and save their cattle from Carney and Fletcher. Australia History During the 1930ââ¬â¢s Germany was expanding its territory and in 1939 they threatened to invade Poland. Germany decided to disobey Britain and France when they told Germany that they would declare war if Poland was invaded. The Australian people do not approve of the German expansion and because they are a British nation they were pulled into the war along with Britain (www. nzacday. org). Australia declared war on Germany on September 3, 1939 and joined the war in Europe to aid its Allies in the United Kingdom (www. worldwariihistory. com). Australia was forced to make a tough decision: to watch after homeland in case Japan attempted to expand its power, or send troops to aid England in the war. Because Japan pledged its neutrality and the British naval base in Singapore would stop any Japanese invasions towards Australia, they decided to commit itself to the European War. Australian troops were not prepared to fight and risk their lives in war. This caused he Royal Australian Navy to be put under British control. They began to train and recruit men and they helped the Royal Air Force in the war against Germany (www. anzacday. org). During 1940 and 1941 troops in Australia helped capture Bardia and Tobruk in Libya because they saw action in North Africa and the Middle East. Once Japan bombed Pearl Harbor and the war was brought closer to Australian homeland, Australia declared war on Japan. The most direct threat that Australia faced was New Guinea. Thankfully, the Americans held off a naval attack on Australia at the Battle of the Coral Sea in May 1942. By the end of WWII, Australia has lost about 30,000 men and women (www. worldwariihistory. com). Also, the Indigenous people of Australia were driven out by the British and many were killed and driven out of their homes. The deaths of aborigines occurred because of the diseases spread by Europeans, the introduction of domestic animals destroyed many natural habitats and fighting in Tasmania. During the early 20th century laws were passed to segregate and protect aborigines. This caused restrictions on where they could live, and work. Families were also broken up (www. australianexplorer. com). Also, during WWII aborigines under the age of five were taken from their homes by white men and sent to live with white families. The British did this because the Australian government thought their race lacked a solid future. The children were never reunited with their families (http://history. howstuffworks. com). Unfortunately after WWII the British wanted to ââ¬ËEuropeanizeââ¬â¢ them. In this case all rights were taken away from the aborigines. During the 1960ââ¬â¢s, the aborigines were given citizenship status but in 1972 they were given limited rights to their own land (www. australianexplorer. com). Australia Analysis During World War II in the 1930ââ¬â¢s and 1940ââ¬â¢s there are many similarities and differences in Australia the movie compared to the countryââ¬â¢s real history. A similarity between history and Hollywood is that they both go into great detail on how horribly the British treated the aborigines of Australia. A difference between the two was how little detail the movie Australia went into when it came down to the war itself and its allies. Throughout the movie the director, Baz Luhrmann does not focus on the key points of the outcome of WWII, the disaster and hardship it put on Australia, and the effects on its people and cities. A similarity of the treatment of aborigines is that in the movie the aborigines were taken away from their families and homes. This was known as the Stolen Generation in Australia. During the movie they were sent away to work on missions on different islands and were rarely seen again by their families. Although this did occur in reality the children were mainly forcefully sent or tricked into living with a white family. The parents were sometimes unaware that their children were even still alive. The government would often tell them their child had died. Where in reality they are living with a white family so they have a chance at a better future. A difference between the movie Australia and reality is how little detail Baz Luhrmann displays on the actual war itself. Throughout the entire movie except for the end, the main idea is focused on cattle and the Stolen Generation. However during the end, WWII begins to take place and the movie displays the war aspect. It does not explain how the war began, the final result, or the results on Australian people. The war began in Germany because they tried to expand their territory into Poland. France and Britain declared war and because Australia was British territory they also joined in the fight. The movie did include when Japan attacked close to Australia at Pearl Harbor, which caused them to go to war against each other. By the end WWII Australia lost about 30,000 men and women.

Pierre Frankel in Moscow: Unfreezing Change Essay
The case describes the conundrum of Pierre Frankel, a devoted employee of H-IT which is a global IT company. He was sent to the Russian subsidiary of H-IT in Moscow, to improve the subsidiaryââ¬â¢s performance and increase profitability. The environment that greeted Pierre on reaching the Moscow office is not at all welcoming: (i) Lebedev, who is the MD for the Russian subsidiary tried to hire a number two for himself but his move was rejected by the upper management. He knew that Pierre was the replacement and considers him a threat. (ii) The subsidiaryââ¬â¢s 450 odd workforce considered Pierre as an outsider who is trying to bring with him a lot of structural changes and break the status quo. (iii) Many guidelines were in place, to ensure efficient functioning of the organization and were followed globally. But they were hardly ever implemented here, in the Russian subsidiary. (iv) The atmosphere that had been a result of Lebedevââ¬â¢s micromanagement discouraged teamwork and expression of new ideas. Not a single file could move from one desk to another without the knowledge of the MD. (v) All this can also be seen as a direct cultural implication of the disintegration of the Soviet Union in 1991, as a result of which, the ââ¬Å"Trust, but verifyâ⬠ideology had been instilled into the Russian way of thinking. Essentially, Frankel had to act as a change catalyst and unfreeze the current state of affairs at the Russian subsidiary. If he is able to change the status quo, he will be able to reveal the drawbacks of the current situation. This is necessary because if the Russians were to improve their ways, it was necessary for them to believe that change is needed. Some constructive steps that he took to learn the Russian ways were: (i) In the first few weeks, he met all the relevent leaders in the organization including the line of business leaders to learn more about the subsidiaryââ¬â¢s operations and laying the ground work for change. (ii) He tried to get into the good books of Nadia Abramova, the head of HR and who was rumored to be very close to Lebedev. (iii) He tried to identify people who were open to learn and willing to change. (iv) He tried to hire a native Russian to assist him with his agenda for change. He was opposed by Lebedev in this endeavor butà Frankel managed to get some resumes with the help of Nadia Abramova. Suggested Solution: The priority areas identified by Frankel were: increasing business predictability, improve sales efficiency and focus on strategic internal processes. To bring about a change in the organization, he had to change the way the employees thought and worked. He had to make the work environment full of energy, collaboration and trust for each other. To bring about this, Frankel had to change himself because the Russians were not going to mould their ways at the command of an outsider. It was just how they had become culturally. To do this, Frankel was correct in looking to hire a Russian guy who could help him connect with the other employees better. He should then try and communicate with Lebedev with a clear-cut agenda and get him on board. Lebedevââ¬â¢s change of outlook is key if productivity is to be increased at H-ITââ¬â¢s Russian subsidiary, otherwise, his services can be done away with. However great his connections may be and however good his communication skills may be, if his management style is proving detrimental to the company, he is no good.

Protecting the Global Environment Essay
1.Introduction Population growth is one of the major environmental issues today. Some people argue, that rapidly growing population is not only problem and humans will not destroy life-support system on which we all depend. Contrary some argue that growing population is a key driver factor of environmental destruction. The purpose of this research project is to explain the main arguments of both sides and to recommend possible action in order to face with most important problems. Many countries see contradictory the problem of population growth. Those country with relatively low population growth but high rates of consumption said that the population is a main problem. Should we try to reduce population growth or consumption, or perhaps both? 2.Human population History According to Cunningham (2000) for a most of human history, population growth was very slow. Many studies of hunting and gathering societies show that the total world population wasnââ¬â¢t more than a few million people before innovation of agriculture and the domestication of animals around 10,000 years ago. The bigger and more secure food supply results in human population to growth, reaching perhaps 50 million people (b.c). Moreover, some historical evidence and description suggest that only about 300 million people were living at the time of Christ. During the Middle Age, many diseases and wars held world population. The main reasons were lack of hygiene and life condition and as consequence made human life short and uncertain. During the most destructive disease, plaque that took many lives between 1348 and 1350, it is estimated that at least one-third of European population perished. At the end of last great plague, there ware about 600 million people on the earth. After 1600 human population increase rapidly and in 1800 reach one billion. It took a century and a half more to reach the 1950 figure of 2.5 billion. But in a post World War II period theà populations was doubled in less than forty years, and exceed 5 billion. By the year 2000 world population had passed six billion. Today we are facing with a human population explosion, in other words every second approximately four or five children are born somewhere on the earth and in the same second two other people die. This means that we have increasing by an average of 250,000 in human population per day, which is equivalent of another Switzerland every 30 days, and a new China every 30 years. (www.nyo.unep.org/action/Text/06-t.htm) When we discussed population growth we must consider that 90% of the projected growth come from undeveloped or currently developed nations of Asia, Africa and Latin America. In these developing countries there are a number of socio-economic realities that lead women to have more children. In economies that depend on family or communal agriculture, children are an economic assets: they provide a valuable labour and the cost of rising them are very low. Many communities around the world still have limited access on adequate health care facilities, which often result in a high infant mortality rates and low life expectancy. When family lose, on average one in tree or four children they usually chose to have as many as it possible in order to maximize the number of children that will survive. On the other hand in developed countries where there are fewer educational and carrier opportunities, there tends to be earlier marriage and child ââ¬â bearing. In some countries woman often start having babies when they are 15 years old, which result in more children per couple 3. Limiting population as a central strategy in protecting environment The debate about whether human population growth is a fundamental cause of ecological problems and whether limiting population should be a central strategy in protecting the environment has long historical roots. The rapid growing of population led the British classical economist Thomas Malthus in 1798 to write Essay on the Principle of Population as it affects the Future Improvement of Society. Madagascarââ¬â¢s forests have been reduced to a narrowing strip along the eastern escarpment. Of the original forest cover 27.6 million acres; only 18.8 acres remained in 1950. Today the number of acres forest is only 9.4 acres, which means that habitat for the islandââ¬â¢s unique wild life has been halved in just forty years. Another example, which shows the process at work, is one village, Ambodiaviavy, near Ranomafana. Fifty years ago the whole area was dense forest. After French colonials burned down the old village, eight families came in Ambodiaviavy in 1947. At firstly they formed only valley bottoms, which they easily irrigated from the stream running down from the top of hills. There was no shortage on land and each family took as much of land as they were capable of working. After forty-tree years number of families grew to thirty-six but all-cultivable lands was occupied, so they started to clear forest, today they two-thirds of the way to the hilltop. However, most analysts accept that increasing population places extra stress on the environment and resources, and there is broad agreement that limiting population is necessary. But how is to be accomplished? According to the Harris (2001) most well known example of this is Chinaââ¬â¢s ââ¬Å"one-childâ⬠family policy. Birth rates can fall rapidly, however especially woman reach higher level of education, literacy, and take benefit from employment opportunities. Thirdly, support family planning initiatives, in order to inform people more about this program and to let them know the benefits that effective family planning could have for their community and the whole global environment. Another step could be encouraging all levels of government support (both expertise and founds). And finally develop special program for women that create more opportunities for them to enter, re- enter or stay it the workforce, especially in undeveloped countries. 4. Human creativity and intelligence can create new resource by sub stituting new materials for old materials. Technology will discover practically limitless new or replacement resources, that pollution will be controlled by technology. While populationââ¬â¢s growth rates are definitely an issue, the size of human population is not the only determinant on the impact on the environment. The impact of people on their environment is not only in their number but also in their location in biosphere theirs level on consumption of energy and materials, and the technology used to attain a given standard of living. Mahatma Gandhi said 50 years ago that there is enough for everyoneââ¬â¢s need, but not enough for everyone greed. According to the Alan Durning of the Worldwatch Institute, population acts as a multiplayer. Therefore, the total human impact on theà global environment can be reduced by the moderating consumption. For example, industrialized nations, home of 22 % of the worldââ¬â¢s population, consume 60% of the worldââ¬â¢s food, 70 % of its energy and 85 % of its wood. They generate almost three- quarters off all carbon dioxide emission, which make them the main causes of most of the ozone depletion. (Hartman, 1994). Moreover, there are numerous countries where governments use inappropriate incentives for a food production, such as excessive subsidies may result from poor policy planning. à ·Taking community action to address Unsustainable Consumption Many different actions can be implement in order to promote the concept of sustainable consumption. One of the actions is to help build awareness. Every individuals, organization and community can help aiming to change attitudes and behavioural toward environmental sound product selection and lifestyle choice. It can be operate an environmental awareness program, which explore links between local production, consumption and environment, while motivating people to change their own behaviour. Another step is work with schools and the media in order to inform future generation. Also to promote green- consumption, encouraging people to purchase ââ¬Å"environmentally-soundâ⬠product whenever they are available. 5. Conclusion: There are many reasons that population growth has direct impact on environment. But which strategy we should choose in order to face with this problem? In the face of such uncertainty, we must ask what is at stake in the risky we chose to take. If the pessimist views of limits on the Earth turn out to be correct, the horror and misery that would unfold as a result of continued population growth. On the other hand, if optimists turn out to be correct, there will be many generations ahead in which a gift of life can be extended to additional billions. It is obvious that we need more than one strategy for dealing with growth. Therefore, solving a planetââ¬â¢s ecological crisis is not just about a having small families.
